THE KINGSTON AND ST. ANDREW CORPORATION (SPECIAL PROVISIONS) (MONA AND PAPINE DIVISIONS) ACT

Act 8 of 2003.

1   Short title

   This Act may be cited as the Kingston and St. Andrew Corporation (Special Provisions) (Mona and Papine Divisions) Act.

2   Application of Act

   This Act shall apply to the Mona and Papine Divisions of the Kingston and St. Andrew Corporation.

3   Certain provisions of Kingston and St. Andrew Corporation Act not to apply

   During the continuance in force of this Act the provisions of-

   (a)   subsections (3), (5), (6) and (7) of section 50 of the Kingston and St. Andrew Corporation Act shall, subject to section 4(8), not have effect in relation to elections held in the Mona and Papine Divisions of the Kingston and St. Andrew Corporation; and

   (b)   section 4 of this Act shall have effect in relation to such election.

4   Identification of elector by fingerprint etc

   (1) In this section "specified equipment" means the equipment provided for the purpose of identifying an elector by fingerprint.

   (2) An elector shall, before receiving a ballot paper and on the directions of the presiding officer, place his finger on the specified equipment for the purpose of identifying that elector by fingerprint.

   (3) Where an elector refuses to comply with subsection (2), the presiding officer shall-

   (a)   draw a line through the elector's name appearing on the official list of electors and, if applicable, in the poll book; and

   (b)   insert thereafter the words "Refused to be identified by fingerprint".

   (4) In the event that a matching fingerprint is not found by means of the specified equipment, the elector shall be required to provide the information specified in section 50(8) of the Kingston and St. Andrew Corporation Act in order to verify the identity of the elector.
